Terms Of Service
These Terms of Service ("Terms") govern your access to and use of nextgentrader.pro and any related applications, platforms, dashboards, or services (collectively, the "Services") provided by NextGen Trader Group LTD, a company registered in England & Wales under company number 17015189, with registered office at 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ ("NextGen Trader," "we," "us," "our").
By purchasing a Challenge, creating an account, or otherwise using the Services, you agree to be bound by these Terms, our General Disclaimer, our Risk Disclosure, our Privacy Policy, and any Funded Trader Agreement applicable to your account.
1. Nature Of The Services
NextGen Trader provides access to a proprietary evaluation platform ("Challenges") through which participants attempt to demonstrate trading proficiency under defined rules on simulated accounts. Participants who successfully complete the applicable Challenge stages may be offered access to a simulated "funded" account, under which performance-based payouts may be issued in accordance with the applicable Funded Trader Agreement and our Payout Policy.
NextGen Trader is a technology and evaluation services provider only. We are not a broker, dealer, exchange, custodian, investment adviser, or asset manager, and nothing in these Terms should be interpreted as creating such a relationship. See our General Disclaimer for full detail.
2. Eligibility
To use the Services, you must be at least 18 years of age (or the age of legal majority in your jurisdiction, if higher) and have the legal capacity to enter into a binding agreement. You represent that you are not located in, or a resident of, any jurisdiction where use of the Services would be unlawful, and that you are not subject to applicable trade or economic sanctions.
3. Account Registration & Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate, current, and complete information during registration and identity verification (KYC), and must promptly update any information that becomes inaccurate. NextGen Trader is not liable for any loss arising from your failure to safeguard your account credentials.
4. Challenge Purchases & Fees
Challenge fees are due in full at the time of purchase and, except as expressly stated in our Refund Policy, are non-refundable. Prices, tiers, and rules for each Challenge are as displayed on the Services at the time of purchase and may vary between tiers or promotional periods. NextGen Trader reserves the right to modify pricing, tiers, or promotional offers at any time, provided that changes do not retroactively affect a Challenge already purchased.
5. Trading Rules & Account Termination
Each Challenge and funded account is subject to specific trading rules (including but not limited to maximum daily loss, maximum overall loss, and profit targets) as published on the Services and incorporated into these Terms by reference. Breach of any applicable trading rule, including through prohibited trading strategies identified in our Trading Rules, will result in disqualification from the Challenge or termination of the funded account, without entitlement to a refund except as provided in our Refund Policy.
6. Payouts & Profit Split
Eligibility for payouts on a funded account is governed by the applicable Funded Trader Agreement and our Payout Policy, including any minimum trading requirements, profit split percentages, and verification steps. NextGen Trader reserves the right to delay, reduce, or deny a payout where verification cannot be completed, where a trading rule breach is identified, or where fraudulent activity is suspected, in accordance with our AML & KYC Policy.
7. Intellectual Property
All content, trademarks, platform software, design elements, and materials made available through the Services are the property of NextGen Trader Group LTD or its licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Services without our prior written consent.
8. Prohibited Conduct
You agree not to: (a) use the Services for any unlawful purpose; (b) attempt to manipulate, exploit, or reverse-engineer the evaluation platform, pricing feed, or trading rules; (c) use multiple accounts to circumvent Challenge rules or fee structures; (d) provide false or misleading information during registration or KYC; or (e) engage in any form of collusion, account sharing, or coordinated trading intended to circumvent risk controls.
9. Suspension & Termination
NextGen Trader may suspend or terminate your access to the Services, with or without notice, if we reasonably believe you have violated these Terms, engaged in prohibited conduct, or where required by applicable law or a competent authority. Termination does not entitle you to a refund of any fees already paid, except as provided in our Refund Policy.
10. Disclaimers & Limitation Of Liability
The Services are provided "as is" and "as available" without warranties of any kind. To the fullest extent permitted by law, NextGen Trader's aggregate liability to you for any claim arising out of these Terms shall not exceed the total fees you paid to NextGen Trader in the twelve (12) months preceding the claim. Full disclaimer and liability terms are set out in our General Disclaimer, which forms part of these Terms by reference.
11. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Republic of Seychelles. Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration administered by the Seychelles International Arbitration Centre (SIAC-Seychelles), seated in Victoria, Mahé, Seychelles, conducted in English, as further described in our General Disclaimer.
12. Changes To These Terms
We may update these Terms from time to time. Material changes will be notified via the Services or by email where appropriate. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
